These Terms & Conditions govern the purchase and use of Sweets Pass products, including the 2026–2027 Founding Member Edition. By purchasing, receiving, or using a Sweets Pass, you agree to these Terms & Conditions.

Sweets Pass is a locally focused discovery program featuring offers from independently owned participating businesses.

Sweets Pass provides access to the offers printed or otherwise identified in the applicable edition of the Sweets Pass. Participating businesses are independently owned and operated and are not employees, agents, subsidiaries, or affiliates of Sweets Pass.

Offers are valid only during the redemption period stated on the applicable Sweets Pass.

Offers must be redeemed before the expiration date printed in the Sweets Pass. Unused redemptions expire at the end of the applicable redemption period and have no remaining cash or credit value.

Expiration dates will not be extended for unused offers.

Each participating business determines the specific item, product, discount, or other offer it provides to Sweets Pass holders.

Unless otherwise stated in the individual business listing, qualifying offers may be redeemed only according to the redemption limits printed in the Sweets Pass.

Offers:

• Have no cash value
• Cannot be exchanged for cash or store credit
• May not be combined with other discounts, coupons, promotions, or special offers unless the participating business allows it
• Are subject to the specific terms printed with each participating business's offer
• May be subject to product availability

Participating businesses may substitute an item of reasonably comparable value if the originally featured item is temporarily or permanently unavailable.

Participating businesses establish and control their own business hours, operating schedules, staffing, inventory, products, locations, and availability.

Sweets Pass does not control and is not responsible for temporary closures, permanent business closures, relocation, changes in ownership, seasonal hours, vacations, staffing shortages, product shortages, weather-related closures, or other changes affecting a participating business.

Sweets Pass does not guarantee that every participating business will remain open or available for the entire redemption period.

The closure or unavailability of one or more participating businesses does not entitle the Sweets Pass holder to a refund, replacement, extension, or credit.

Participating businesses are independent businesses and retain the right to refuse service consistent with applicable law and their normal business policies.

A business may also refuse a Sweets Pass redemption if the pass is expired, altered, duplicated, damaged in a way that prevents verification, previously redeemed beyond the permitted number of uses, used contrary to the stated offer terms, or reasonably suspected of misuse or fraud.

Sweets Pass does not control individual service decisions made by participating businesses.

Some participating businesses may operate under different business models, including delivery-based services or offers that involve additional purchases.

Any required minimum purchase, delivery charge, service fee, advance ordering requirement, geographic limitation, reservation requirement, or other condition applicable to an offer will be disclosed in the participating business's listing whenever applicable.

Unless specifically stated otherwise, Sweets Pass covers only the item or benefit described in the individual offer. Customers remain responsible for any additional purchases, delivery fees, taxes, gratuities, or other charges associated with their transaction.

Sweets Pass and participating businesses may need to make reasonable modifications to an offer because of discontinued products, supply availability, operational changes, or circumstances outside their control.

When reasonably possible, participating businesses may provide a substitute item or offer of comparable value.

A change in flavor, variety, product selection, or comparable substitute does not constitute grounds for a refund.

All Sweets Pass sales are final.

Once a Sweets Pass has been purchased, no refunds, exchanges, credits, or cancellations will be provided, except where otherwise required by applicable law.

This includes, but is not limited to, situations involving:

• Unused or partially used Sweets Passes
• Failure to redeem available offers
• Changes in personal circumstances
• Relocation or travel limitations
• Participating business closures or relocations
• Changes in business hours
• Product substitutions or availability
• Failure to redeem offers before expiration

Please review the applicable Sweets Pass information before completing your purchase.

Sweets Pass holders are responsible for safeguarding their physical Sweets Pass.

Lost or stolen Sweets Passes may not be replaced because redemption history may not be independently verifiable.

Sweets Pass reserves the right, but is not obligated, to replace a damaged pass when sufficient proof of purchase and remaining eligibility can be verified.

Sweets Passes may not be copied, reproduced, altered, counterfeited, digitally duplicated, resold for commercial purposes, or manipulated to obtain additional redemptions.

Participating businesses and Sweets Pass may refuse or invalidate a pass reasonably believed to have been altered, duplicated, fraudulently obtained, or misused.

Misuse may result in cancellation of the remaining Sweets Pass benefits without refund.

Sweets Pass may be purchased as a gift unless otherwise stated.

Unless a particular edition states otherwise, the physical Sweets Pass may be used by the person in possession of it, subject to all redemption limits and other applicable terms.

Redemption limits apply to the Sweets Pass itself and do not reset when the pass is transferred or gifted to another person.

Sweets Pass promotes and connects customers with independently operated participating businesses.

Sweets Pass does not own, operate, manage, supervise, or control participating businesses and is not responsible for their:

• Products or food preparation
• Ingredients or allergen information
• Food safety practices
• Customer service
• Employees
• Premises
• Business operations
• Delivery services
• Hours or availability

Questions regarding ingredients, allergies, dietary restrictions, preparation methods, or food safety should be directed to the participating business before ordering or consuming a product.

Sweets Pass does not independently verify ingredients, allergen statements, dietary claims, or food preparation practices of participating businesses.

Individuals with food allergies, sensitivities, or dietary restrictions are responsible for discussing those needs directly with the participating business before redeeming an offer or consuming any product.

Sweets Pass makes reasonable efforts to provide accurate information regarding participating businesses and offers at the time an edition is produced.

Business information may change after publication.

To the fullest extent permitted by applicable law, Sweets Pass is not responsible for losses, damages, injuries, expenses, dissatisfaction, or other claims arising from the products, services, conduct, premises, operations, or actions of independently operated participating businesses.

Because Sweets Pass is a printed product, information contained in an edition reflects participating business information available at the time of production.

Changes occurring after printing may be communicated through sweetspass.com, Sweets Pass social media channels, email communications, or other reasonable methods.

Customers are encouraged to confirm a participating business's current hours and availability before visiting.

The Sweets Pass name, branding, graphics, written content, layout, and other original materials are owned by Sweets Pass unless otherwise indicated.

Participating business names, logos, trademarks, and other intellectual property remain the property of their respective owners.

Sweets Pass content may not be reproduced, distributed, or used commercially without permission.

Sweets Pass may update these Terms & Conditions when necessary to reflect changes in business practices, website operations, legal requirements, or future Sweets Pass editions.

Any material change affecting an already-purchased printed offer will not retroactively eliminate a valid redemption benefit except where necessary because of business closure, legal requirements, fraud, circumstances outside reasonable control, or other conditions described in these Terms.

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
